Acceptable Use Policy

You will be held responsible for all actions performed by your account whether it be done by you or by others! If server security is compromised,the account holder is responsible for all violations of the TOS and AUP, including SPAM, and all disconnect and reconnect fees associated with violations.

Statement of Purpose
The Primary Purpose of Fastup is to provide our clients with the resources necessary to put their internet services online reliably in a fast, high availability environment that responds quickly to each client’s individual needs.

Regarding Ultimate Liability
The Customer is ultimately responsible for individual server security. Fastup claims no liability for content.

Network Misuse
All customers are allowed access to the public network, however misuse of the network in any way, including interference, will result in a violation of the Acceptable Use Policy (AUP). All Violations of the AUP shall be subject to review by Fastup, and an appropriate course of action shall be taken. Proper use of public network must comply with all Dutch and international laws. Customer’s assume full liability for all content which they place on the server. Forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting is deemed a violation of this AUP.

Sabotage
Any type of sabotage, regardless of intention shall be grounds for termination of an account. This includes, but is not limited to, abuse of the remote reboot system by using it multiple times in a very short amount of time for improper reasons.

Network Security
Customers are required and obligated to maintain all security on their servers. Any and all additional charges that are incurred due to customer lack of monitoring or security are the responsibility of the customer.

Denial of Service Attacks
Any activity which affects the ability of other people or systems to use any services or other Internet services. This includes “denial of service” (DOS) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited. It is the client’s responsibility to ensure that their server is configured in a secure manner. A client may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. Unauthorized entry and/or use of another company and/or individual’s computer system will result in immediate account termination.

Monitoring Policy
Fastup does not actively monitor the content on its servers. Dedicated server and VPS content will only be reviewed upon complaint. Content that does not violate Dutch or international law or the AUP or TOS is deemed in compliance and shall remain intact. Legal adult content is permitted. If content is deemed to be in violation of the AUP or TOS, it shall be reviewed by Fastup, and a course of action shall be taken to correct the problem, which may result in termination of the account or service.

IP Blacklists
If any Customer or any Third Party User that is a customer of our Customer uses Fastup services, network, or its physical infrastructure in a manner that causes Fastup,or any IPs issued by Fastup to be blacklisted or blocked, Fastup reserves the right to suspend or terminate services of such customer and/or suspend or terminate the access to services, network, and/or its physical infrastructure. Operating Fastup service on behalf of, or in connection with or reselling any service to persons or firms listed in the Spamhaus Register of Known Spam Operations database at www.spamhaus.org shall constitute a violation of this AUP.

IP Addresses
All IPs Addresses issued by Fastup are in the sole control of Fastup. Customers retain no ownership rights to any IP addresses issued by Fastup. Customers may not transfer IPs from Fastup. Any customer purchasing IP addresses in addition to their base allocation may be required to submit justification forms as well as submit to additional terms depending on the amount of IP addresses desired. VPS customers are limited to a maximum of 12 IP Addresses per VPS. For more information about IP Addresses, please contact sales@fastup.org.

IRC/Bittorrent/P2P/Warez
IRC Usage is strictly prohibited on all Fastup services. Customers may not operate and maintain IRC servers whatsoever. Use of IRC plug-ins, scripts, add-ons, clones or other software is prohibited. Fastup does not allow the use of both Peer to Peer as well as Bit Torrent. Warez linking and sharing on the Fastup network is also strictly prohibited.

Proxies
Public proxies are strictly prohibited on all Fastup services. All proxies may only be utilized for private use and legal purposes. Fastup has a zero tolerance abuse policy and does enforce it. Any abuse determined to be originating from proxies on the Fastup network may be subject to instant account termination. All private proxies must be authenticated and secured. Fastup services cannot be utilized for the selling/distributing/providing of proxy services.

Violation Claims
Any Claim of Violation of the Acceptable Use Policy that is being submitted must be verified and include name, contact information, IP address, and description of the violation. This Acceptable Use Policy Applies to all Customers, including the customers of our customers (Third Party).

Fastup reserves the right, at its discretion, to refuse new service to any individual, group, or business. Fastup also retains the right to discontinue service with notice for repeated violation of the acceptable use policy over time. Fastup retains the right to discontinue service for any client.

Virtual Private Servers
Fastup closely monitors all activity and resource usage of Virtual Private Servers located on its network. Should, at any time, a VPS be determined to be abusing the resources allocated, Fastup reserves the right, at its discretion, to take all actions necessary to regain stability of the physical hardware. Such actions include, but are not limited to: killing processes, limiting bandwidth throughput, shutting down a server, and suspending services. Fastup is not required to inform the client of such actions being taken, nor are they required to disclose information regarding the situation.

Backup Services
Fastup provides all services with no warranty. It is the sole responsibility of the client to configure and maintain their own backup routines. Fastup is not liable for any damages caused due to misconfiguration, corrupted or non-existent backups, or any other reason not expressly listed. Backup services rendered by Fastup are for the sole purpose of storing data and cannot be utilized for other purposes. At the discretion of Fastup, accounts may be monitored and subject to termination should use be deemed inappropriate. All files stored on Fastup servers must be of legal content. All content stored must abide by all policies set forth by Fastup and the Dutch and international laws. Backup services are provided with unmetered transfer. Unmetered, in this instance, refers to the fact that we do not actively monitor bandwidth transferred by individual accounts. Should any account be determined to be transferring unacceptable levels of bandwidth, it may be immediately terminated at the sole discretion of Fastup. Backup accounts, on average, should not consume more bandwidth than approximately ten (10) times the disk space allocation.

Users on backup servers may not navigate from the account home directory (/home/username) without the express permission of Fastup. Any accounts found to be navigating the filesystem above their home directory will be subject to immediate termination under the assumption the account is attempting to reverse engineer, or gain access, to unauthorized areas of such servers.
